National Scavenger League, LLC (“NSL”) invites registered users of the mobile application (the “App”) to purchase tickets using Apple Pay (the “Ticket(s)”) to participate in one (1) day scavenger hunts that run from 9 a.m. to 9 p.m. on a specified day in a specified city (the “Hunt(s)”) for the opportunity to win one of three (3) cash prizes (the “Prize(s)”), according to these Scavenger Hunt Official Rules (the “Official Rules”). By purchasing a Ticket, you agree to these Official Rules:


ELIGIBILITY: Hunts are open to registered users of the App that are at least eighteen (18) years of age or older and who have agreed to the Terms of Use Agreement, except that employees of NSL and their relatives are not eligible. Registered users must purchase a single Ticket using Apple Pay to participate in the Hunts (the “Participant(s)”). Minors may participate as long as they are accompanied by a registered user at least eighteen (18) years of age. While Minors cannot compete for Prizes as a Participant, Minors may partake in the Hunt as a Team Member for entertainment purposes only. The price of Tickets is prominently displayed on the App before purchase. Participants may compete individually or with a single team member (the “Team Member”). Participants may add a team name and Team Member, if any, in their profile settings on the App. Team Members need not purchase a Ticket, but Team Members that do not purchase a Ticket will not be considered a Participant in the Hunt and will therefore be ineligible for any Prize. For clarity, Prizes will only be paid to the winning registered Participants who purchased a Ticket. Residents of Arizona, Arkansas, Connecticut, Delaware, Florida, Louisiana, Maryland, Montana, South Carolina, South Dakota, and Tennessee are ineligible to participate in Hunts or win Prizes.


HOW TO PLAY: At the beginning of the Hunt, the Participants will receive a notification in the App that provides access to a series of clues (the “Clues”) which, when solved, direct Participants to a series of locations (the “Location(s)”). Once a Participant has arrived at the Location indicated in the Clue, the next Clue will be revealed, directing the Participant to the next Location. This continues until either (a) the Participant has accessed twenty (20) Clues and traveled to twenty (20) Locations, or (b) the Hunt ends at 9 pm on a specified day-. During the Hunt, Participants can track their current estimated placement in the App; however, this estimated placement is not official until reviewed and confirmed by NSL after the Hunt. 


DISQUALIFICATION: Participants will not trespass on private property or engage in any other criminal or tortious behavior during the Hunts. Participants will not cheat or engage in collusion, including but not limited to manipulating the location data collected on the App during Hunts. If NSL, in its sole discretion, determines that a Participant has violated or attempted to violate these Official Rules or the Terms of Use Agreement, that Participant will forfeit their right to any and all Prizes, and NSL may prohibit Participant from participating in future Hunts.


ODDS OF WINNING: The odds of winning are determined primarily by a Participant’s skill (and, if any, Team Member’s skill) at solving Clues and traveling to Locations in a speedy fashion relative to other Participants. The odds of winning are impacted by the maximum number of Participants in the Hunt. . Hunts will have a maximum number of one thousand (1,000) Participants. If NSL reduces the maximum number of Participants in any given Hunt, the number of Participants will be disclosed by NSL to all Participants prior to purchase of a Ticket.


HOW TO CLAIM A PRIZE: The first, second, and third Participants to reach the twentieth Location will place first, second, and third, respectively, or, if less than three Participants reach the twentieth Location by 9 p.m. on the specified day, the three Participants that made it to the most Locations in the least amount of time will place first, second, and third, respectively. (the “Winners”). Winners will receive a confirmation by email or other electronic methods of communication. Winners must respond to the confirmation email within thirty (30) days to claim the Prize and provide a complete response to all questions sufficient to allow NSL to mail the Prize and any necessary legal or tax documentation to the Winners. NSL is not responsible for misdirected emails or delivery failures. Winner’s failure to respond in a timely manner may result in forfeiture of the Prize by Winner.


VERIFICATION: After Hunts, NSL will review the Location data and other information collected from the Participants to confirm that no cheating and/or collusion has occurred. If NSL, in its sole discretion, determines that a Participant has engaged in or attempted to engage in cheating or collusion, that Participant will forfeit their right to the Prize, and NSL may provide that Prize to the next placing Participant. The top three (3) finishing Participants of each Hunt will receive a Prize in decreasing amounts. The amounts of each Prize per top three (3) placement will be prominently displayed on the App before Participants purchase Tickets.


PRIZE SHARING: NSL expressly disclaims any responsibility for segregating, dividing, or distributing Prizes with Team Members. NSL’s sole responsibility for providing Prizes, if any, is owed to the Participant only, and not the Team Member. Participants are solely responsible for segregating, dividing, and distributing any Prizes with Team Members. Any such Prize sharing agreement shall be governed solely by an independent, private agreement between the Participant and the Team Member. NSL is not responsible for enforcing any such agreements. Participant and Team Member agree to release us, and hold us harmless, from any and all claims arising from such separate agreements, and that any claims arising from such agreements shall be asserted only against the Participant or Team Member, and not against NSL. 


GENERAL CONDITIONS: Participants agree not to contest the outcome of Hunts and to fully comply with the Official Rules. Winners are solely responsible for all federal, state, and local taxes. Hunts are void where prohibited. NSL reserves the right to cancel, suspend, and/or modify the Hunt(s) if fraud, technical failures, or any other factor beyond NSL’s reasonable control impairs the integrity of the Hunt(s), as determined by us, in NSL’s sole discretion. NSL reserves the right, in NSL’s sole discretion, to disqualify any Participant that cheats or otherwise attempts to tamper with or circumvent the entry process or the operation of the Hunt(s), or that acts in a disruptive manner or in violation of the Official Rules. Any attempt by any person to deliberately damage the legitimate operation of Hunts may be a violation of criminal and civil laws. NSL reserves the right to seek damages from any such person to the fullest extent permitted by law. NSL’s failure to enforce any term of the Official Rules shall not constitute a waiver of that provision. In the event of any inconsistency between these Official Rules and the Terms of Use Agreement, these Official Rules will control.


RELEASE AND LIMITATIONS OF LIABILITY: Participants agree to release and hold harmless NSL, the App, and NSL’s respective directors, officers, parent and sister companies, members, employees, attorneys, affiliated organizations, and agents for any damage, injury, death, loss, or other claim, liability, or cause of action that may result from or arises out of Participant’s participation in the Hunt(s) and Participant’s acceptance or use of the Prize, including, but not limited to: (a) unauthorized human intervention in the Hunt(s); (b) technical errors related to computers, servers, providers, location systems, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Hunt(s) or the tracking of participants’ locations; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Hunt(s) or Participant’s receipt or use of the Prize. Participant further agrees that in any cause of action, NSL’s liability will be limited to the price of the Ticket, and in no event shall NSL be liable for attorneys’ fees. Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Except where prohibited, Participant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Hunt(s) or the Prize shall be resolved under Michigan law, without respect to any conflict of law issues, and Participant consents to exclusive venue and jurisdiction in the courts located in Detroit, Michigan.
